Housing Rent Increase Restriction

Purpose:
The purpose of the Housing Rent Increase Restriction policy is to guide the freedom of landlords, especially of public housing facilities, and regulate the leverage such authoritarians have over the increase of rent or affordable living.

Additional Authority:
A statute shall be passed that a city’s rent board can not approve an increase in rent requested by landlords of any facility without thorough inspection of the upkeep of the housing establishment over a lengthy period of time, along with viable evidence that proves that there was continual maintenance of all health and safety aspects of the buildings. In addition, there must be a reasonable limitation in the extent of which the rent shall be increased (proposed and voted on by a socio-economic diverse board and approved by the mayor) if the increase was deemed necessary and relevant for the development of the facility. Also, it must be proven that the increase is not a result from intentional rezoning to the building so that it would no longer be under a rent controlled area.

Scope:
The Housing Rent Increase Restriction policy will primarily affect individuals and small families in neighborhoods in danger of systematic gentrification (majorly marginalized communities with a large ethnic minority community) and renters in zones with unregulated housing rents. The policy should also affect organizations that have a history of corrupt regulations on housing policies in cities, such as the New York City Housing Authority (NYCHA).

Responsible Party:
The responsible party for this policy will be city mayors and the city’s settle housing authority. Collaboratively these force in a city will ensure that actions and regulations are being enacted within the guidelines of the policy’s restrictions.

POLICY
I. Policy Statement

Landlords of housing facilities within the boundary lines of a city will have to abide to a percentage limitation of yearly and/or monthly rent increases for its tenants, with a minimum of a thirty day notice for their renters, that will be proposed, reviewed, and voted on by a socio-economic diverse board and approved by the mayor. Before an increase in the housing rent is approved the board must review that there is irrefutable evidence that the facility was continually kept up to date in designated health and security codes over a lengthy period of time, the increase will not be used to cover expenses for building issues that could have been prevented by the landlord in advance, and the increase will remain in a reasonable bracket of the market and its demands.

II. Procedure (How to implement it)

The policy will be implemented in the yearly or monthly city board meetings when designating that time period’s rent increase. In addition, there should be no designated areas for unregulated housing zones should be either rent controlled or rent stabilized. Landlords will be held accountable by fines if policies are broken.
